Unconstitutional Practice By CPS
Yes it is illegal and an unconstitutional practice to remove children which results in punishing the children and the non-offending parent. In a landmark class action suit in the U.S. District Court, Eastern District of New York, U.S. District Judge Jack Weinsein ruled on Nicholson v. Williams, Case No.: 00-cv-2229. This suit challenged the practice of New York’s City’s Administration for Children’s Services of removing the children of battered mothers solely because the children saw their mothers being beaten by husbands or boyfriends. Judge Weistein ruled that the practice is unconstitutional and he ordered it stopped.

I am a grandmother who is trying get my 3 grandchildren in Arizona. Even though I trust my children will make it happen. I am disgusted by some of the ways these people handle some cases perhaps is all cases. Is terrying to think they remove children without first looking into what the problems is. Rheybshould place children with Family first not straight to foster families. There is money involved which I believe they make based on placements and adoptions is insane in my eyes. They are supposed to help families come together but instead seems to me they try keep them apart separate them and break them. I have not seen my grandchildren in 2 months ans even though my better half was waiting to try to sue...I had to be the one to bend my arm and try make peace with them .I have to see my grandchildren and let them.know they are coming home soon. My heart hurts and I feel like dying do to all this mess and not having money to hire lawyers who ask $20,000 to start a CPS fight. Or $5,000 to be able to become part of a case is insane. I agree to do anything they want and need so I can see my grandchildren and try get them in my house. I am terrified of drinking one drink I gave up alcohol, and any medications they believe to be bad in their eyes. I even asked my doctor to stop my ADHD medications. I don't smoke so Im glad but the way they do things is beyond me. I believe they target low income people and if ainused ton love CPS now is the opposite. I thought they are there to protect those who needs protecting help the families to get help and get them back on track. They disqualifies my mother because she cannot speak English and my daughter living with her who is 18 and in good standing both. Daughter graduated highschool.earlier . I have 4 kids myself and they all graduated they all have jobs they all are good kids. My mother foe being 80 years old and speaks Spanish they said No Even though my daughter lives with her and she speaks mostly English. Is almost as if they wanted to put the kids in foster homes. This is insane and if I die of sadness from all this mess I hope someone co tinues to make things right and that places such as this one do NOT take advantages of others. Children will forever want and seek their parents when taken and their lives is never the same. This is why I believe personally that children need should stay with parents or Family. Since our Family is huge ...I do not understand their Thinking. While I suffer in silence and wait to see my grandkids and tears are unstoppable I feel as if my heart will give up soon. After being put on Anxiety medication because of all this mess. I feel worse instead of being upset I am more like down sadness is heavy. Parents need help and guidance but children should never be taken away unless there is no hope for them to correct the situation or if the father or mother do not want to be parents. Grandparents should be part of the case always. Sorry foelr such long story. There is more. Just im all over the place with my pain in my heart... I hurt foe them because they probably ly think Grandma and Grandpa forgot about them.or we don't care. How Dare they to take our children as if they are objects, with no feelings. As my grandson yells foe my son to please take him home and foe me to hear such things destroys my heart and I hurt doe their pain my grandchildren pain and while in someone else's care I sure hope these foster parents are being good to my grandchildren. Putting one of my grandkids ina group home was the worse ever... based on what I know about group homes made me almost lose my mind...feeling terrier of what can be happening while in such places . These are babies litgle.kids and no matter what ages they hurt, children suffer and if I love people specially children imagine my pain foe my own grandbabies. Im.tirn apart because of CPD or DCS.
